Second degree vehicular homicide and second degree kidnapping are different. However, Heatley pleaded guilty and let assume Varlamov is guilty (no matter pleaded or charged) as well. Which crimilal idiot should see no more ice? Don't you think you too quick to ban Varlamov from hockey? frankgrimes, I think, you should consider skipping next jury duty. (which we likely never will) Especially since the laws in this country are so convoluted and f***ed up, and they'll lock you up and hit you with a half dozen charges just for blinking wrong. (hence the highest prison population on the planet) You know when you were a kid and your mother said "com here young man/lady" and grabbed your arm? Well, technically, since she touched your arm, that's felony assault and since she moved you from your previous position, that is kidnapping. As an adult example, a few years ago a friend of mine had these exact same two charges filed against him. What happened was his girlfriend at the time came home all f***ed up on some sort of hard drugs and started going literally crazy and screaming and tearing his place up. He finally got her to calm down and told her she had to leave. He opened the door and said come back when you are sober and calm down and lightly put his hand on her shoulder and escorted her the two feet out the door. I was actually there when this happened with my girlfriend at the time, so I saw exactly what happened. Anyway, we leave and the next day, we come to find out that HE was charged with kidnapping and assault because several hours later the girl decided to call the cops for whatever reason. According to the cops, making her leave HIS house was considered kidnapping, and since he lightly put his hand on her shoulder, they decided to charge him with assault too. Oh, and they flat out refused to charge her with anything despite the fact that she tore his house up and scratched his arms up while in a drug fit, while he did absolutely nothing to defend himself. This...unfortunately, is the system we live in here... *sigh* I am definitely NOT excusing Varlamov if he actually did beat and kidnap his girl, but from the one story I have encountered first hand and others I have heard about over the years, most of these "kidnapping and assault" charges the cops conjure up are BS and not at all what the name of the charges would have you think. 3 ami, Nev and wingslionstigers reacted to this Share this post Link to post Share on other sites

What happened to your friend is an absolute miscarriage of justice, but don't kid yourself into believing that what happened to him is the norm across the country, because it's not. Someone who commits manslaughter had no intention of harming anyone, generally its a death as the result of an accident. If Varlamov did the things he is accused of, its not an accident but a willful act intended to hurt a woman. 55fan 5,133 Report post Posted November 1, 2013 I've had friends screwed over on both sides of the issue- abuse victims who weren't helped and also victims of a judicial system that can (emphasis on can) be so to-the-letter anal that a crime is prosecuted where none existed. Considering that what everything I've heard is conflicting, I'll wait for the movie. (IOW wait to see how it ends and get the short version) I still say people need to learn how to defend themselves. This is not in any way blaming the victims; it is merely noting that assaults occur and need to be handled. Although the legal system is there for dealing with things after the fact, a good weapon and/or self-defense class helps during the attack itself.
