    Vincent Lecavalier

    Lecavalier is a stud that some team will overypay for this off season. I heard that one of the reasons the Smyth talks broke down in EDM is because they are saving money to get Vinny and they thought signing that huge contract with Smyth would prevent them from doing that. There are quite a few teams with a whole lot of money this offseason that are going to nail top FAs like Lecavalier, then this board will explode with anger at Holland for trying to nab 1 or 2 second tier guys for cheap.

    Calder no longer worst +/- in the league!

    Is anyone excited about Calder filling the role of Maltby? Similar style of play, more offensive upside, a little gritier, younger...I am excited to see the team replace itself. Being a Red Wings fan, this doesn't happen too often. Maltby should get a hardy thanks and a bag of golf clubs, Calder should get a contract.

    Because Bertuzzi was convicted of criminal charges, the insurance indemnity contract was likely breached. (Criminal intentional torts are rarely, if ever, covered). Anything Moore goes after Bert for is probably out of pocket. That means Bert is paying all the legal fees and all of the reward.

    It would be really hard to prove the causation element of his prima facie case against the teammates that jumped on later. There, because they did not initiate the incident, there would have to be an even closer link between them and the injuries. With Bertuzzi, it is pretty clear that his actions are the actual and proximate cause of the injury, regardless of whether Moore's neck was broken by the punch, the fall, or the piling on. EDIT: Mods, thank you for deleting the despicable comment made on page 1. LGW is impressive in its maturity.

    Alright guys, I won't make too big a deal out of this. Suffice it to say, that is not how insurance works. If the Avs paid Moore's bills because of their contractual relationship, he is almost always bound to press charges against an intentional tortfeasor.

    Unfortunately, you are talking to a real life litigator. Yikes. So since I did not use the internet, I will thank you for complimenting me on my massive intellect! The fact is, you can argue over damages all you want, but you have no clue what the actual damages were, and I am telling you from experience, 20M actually isn't a huge amount for a personal injury case where the spine was broken, especially with explicit intent. You seem to be backing off of your comment (which you should) where you attacked Moore for asking way more than he was entitled to as a "4th line scrub." I am glad to see that. Lastly, do not conflate the issues of the validity of Moore's claim with how Bertuzzi should respond. Because I have faith in the legal system, I think not only should Bertuzzi fight it to the best of his ability, he should not be punished further than that which the judicial system has meted out. Don't worry about it, I have made comments I wish I hadn't in the past too. I just wanted to show you that it is not clear that Moore is asking more than he is entitled to. Spinal surgery is a rare expertise, and those surgeons are expensive. Not to mention everything else... EDIT: spelling.

    Non Sequitur. Are you trying to confuse me with non-logic? I am saying that Moore didn't bring the suit merely because he thought he would have made that much money in the mean-time. He brought the suit because he has a stack of bills on his desk that add up to millions of dollars. He is currently at a loss and would like to be made whole. Your insinuation that it is some kind of "get rich quick" scheme is ignorant of the heart-ache and hassle that comes when bringing a personal injury tort action under the common law. That being said, it doesn't always all come down to money.

    I am on the side of leaving Bertuzzi alone since he has done all that the judicial system, and the NHL has asked of him, but this is not a good argument to make because: 1. The 20M includes lawyers, doctors, physical therapists, loss of consortium, loss of enjoyment, lost wages, pain and suffering etc. It is incredibly ignorant, and callous to talk about how much a "4th line scrub" would have made. 2. Moore will never play NHL again for a number of reasons, not the least of which is insurance and liability reasons. He may be working out and skating, but no team is going to take a chance on him.

    If you don't like the term of his suspension, you should be mad at Bettman, not Bertuzzi. If you don't like the sentencing of his criminal trial, you should be mad at the Canadian jurisprudence system, not Bertuzzi. If you don't like that he is using the adversarial system to determine how much money he should pay Moore, you should be mad at the common law, not Bertuzzi. The only argument you have left against Bertuzzi, is that he should punish himself. However, not only does that punish Bertuzzi and his family, it punishes Moore's chances of getting even a fraction of the civil suit's reward. Further, I think that opinions like that punish all of society. If we really want people to pay their dues and then become productive members of society, we cannot eviscerate them from that one thing which they received education and training to contribute in. Self flagellation is a lose-lose-lose.

    I am not naysaying here, just have a question: Has Bertuzzi fought anyone since the Moore incident? I am not attacking him, just wondering what that did to his psyche. I could see him being shy about protecting Z and Dats after what happened when he tried to protect Naslund. He still has the skills/grit we need, but I don't know if he still has the desire to get dirty. I think this is a fair question.

    These stories (most of which you do not hear about) are what make all of this "internet general managing" so infuriating to listen to. The reality is no one here has the slightest clue what Holland, Nill, Bowman, Yzerman and Illitch are dealing with.

    It seems like the overwhelming coaching move on this board is a kick in the ass. I am not sure he needs that as much as a good winger (as many have already stated). Lang is too set, and too slef-confident to have a demotion get him back into gear. Right now, we need to pull him back into the team by giving him some talent to play with. Try Flip and Hudler on the wings. Anything. I think demoting him would really screw us for the playoffs.

    I just had a thought: How much motivation would must guys have if they were talented enough to be a first line center on many teams in the league, but instead were stuck with 2 Wingers that had no finishing ability whatsoever? I'm not saying Lang is great, but maybe he'll return to form if we can get him someone who can play, so he has a bit more fun out there.

    Heaton, I have respect for your posting, so I am going to try to explain the disagreement instead of get spittle all over my keyboard. - I did not say that it wasn't penalized, but my comment was vague, so I get how you took it that way. - Lupul has a lot more talent, and worth to the EDM organization than you are giving him credit for. You are right that he is not as loved as Zetts, so it was probably a bad analogy, but he is a young star for them. - I am not acting like the Oilers have not done it 10 times before, I am acting like we should be consistent with what we condemn and what we condone. If it is fine to retaliate with cheap shots, then Dats, Zetts and Lids better have their heads up. If Kronner had done that to Torres, I have a lot less of a problem with it. EDIT: I have not heard any uproar, so please don't throw me in that crowd. All I am saying is it is dirty, and more players are hurt with hits like that now, than ever before.

    That's fine. Then don't complain when it happens to Zetterberg, because Lupul is like their Zetterberg (future of the franchise). It was a dirty hit, he should have been penalized. If you like hockey, you should care, because it takes a heck of a lot less talent to do that, then to be a great player. If we are "fine" with dirty hits, then the league will continue to go to s***.

    Update on Holland's search for forwards.

    Like it or not, we have invested in Kronwall. So, I can see Barnes' argument to allow Kronwall to step up and take more ice time. Kronwall has been scouted as an offensive-defenseman. Add to it that we all know he has a bit of a propensity for injuries, and I think the recipe is placing Kronner with a physical, stay-at-home defenseman. Let Kronwall lead the break-out, and let him know that knocking bodies isn't his #1 priority. You give a kid with that much talent (1) responsibility, and (2) clear, attainable goals, and then you can judge whether or not he's got it.
