New Developments:

Oilers won't comment after Khabibulin charge elevated

EDMONTON -- Nikolai Khabibulin has been handed an additional charge for a driving under the influence incident in Arizona.

The Edmonton Oilers goaltender is now charged with extreme DUI, with is automatic if a person's blood alcohol level is higher than .15.

The elevated charge by law enforcement officials in Arizona was reported by CTV Edmonton on Monday.

J.J. Hebert, a spokesman for the Oilers, said the hockey club won't be commenting on the case, which is now before the courts.

He also refused to answer any questions about whether this latest development will affect the goalie's hockey career with Edmonton.

Khabibulin, 37, was arrested after a black Ferrari was seen speeding down a street in Scottsdale Feb. 8.

Police allege the vehicle was travelling at an estimated 60 miles per hour (96 kilometres per hour), when the speed limit along that stretch of road is 45 (72 km/h).

Khabibulin has also been charged with excessive speed.

He joined the Oilers in the off-season after stints with the Chicago Blackhawks, Phoenix Coyotes and the Winnipeg Jets, as well as a run with the Tampa Bay Lightning that included a Stanley Cup win in 2004.

The Oilers had high hopes for the Russian and signed him to a US$15-million, four-year deal. But he has missed most of the season with back problems and had season-ending surgery for a herniated disc in January.

Extreme DUI? Did he do a 560 twist in the air on a snowboard while drunk?

like i said, they dont f*** around with DUI's in arizona. ive seen people from other states get stranded here because of the huge bills and court appearances. no tolerance is what they call it ;) people that live here usually get breathalyzers installed in their cars that wont turn on unless completely sober.

From TSN :

Edmonton Oilers' goalie Nikolai Khabibulin was convicted Friday of three charges related to drunk driving and speeding in Arizona earlier this year.

The four-time all-star could face up to six months in jail when he is sentenced Tuesday.

Khabibulin was also found guilty of excessive speeding. His lawyer, Mark Dubeil, said in an email that one charge of impaired to the slight degree was dismissed.

Police said when Khabibulin was pulled over on Feb. 8, his blood alcohol content was .164, over twice the state limit.

Court documents indicated he was clocked going 110 kilometres per hour in a 70 km/h zone in his Ferrari.

Maybe he should claim to be an "UNDOCUMENTED LABORER." Then he can commit whatever variety of heinous offenses he feels are appropriate (assault, rape, murder, drug-running, kidnapping, weapons violations, trespassing, etc.) and the oh-so-sensitives in L.A., New York, and Washington D.C. will come flocking to his aid, pointing out that his DUI was simply the results of the mean-spiritedness of those bad Arizona citizens!

In soviet russia DUI commits you!

Had to do it...

In all seriousness, I agree with the sentiment... hes going to get a slap on the wrist for something that any of us normal jackoffs would get jail time/suspension of privileges/fines/fees/tickets

Does this mean his name will be taken off the Stanley Cup?

Why would the NHL do that when the Cup is simply the ultimate reward for what you accomplished on the ice? Besides, if you're going to judge Khabibulin, you have to judge everyone else with a character flaw, alcohol/drug problem, etc. whose name is on the Cup (and there are a number of those guys who were good or even great players).

The NHL has only removed a name from the Cup once, and it had nothing to do with character flaws (heck, he wasn't even a player or a significant part of the front office). I really doubt they would ever deny a player his on-ice accomplishments due to an ex-post facto incident.

From TSN :

Edmonton Oilers goaltender Nikolai Khabibulin was sentenced to 30 days in prison in a Scottsdale, Arizona courtroom on Tuesday.

The 30-day stay in jail was the minimum sentence Khabibulin could have received under Arizona law. The maximum sentence would have been a six-month jail term.

Khabibulin was found guilty on Friday of three out of four charges against him.

...

...

Khabibulin has appealed the decision, which starts a process that could take several months to complete.

...

What Baretta said.
